2 1. Information Collected Through Our Site
3 We gather two basic types of information through the Site: personally identifiable information that identifies a person as an individual ("Personal Information") and non-personally identifiable information, which includes aggregated information, demographic information, IP addresses and any other information that does not reveal a person's specific identity ("Non-Personal Information").
4 Personal Information. You do not have to provide Personal Information to use the Site. However, you may need to provide certain Personal Information to use some of our services. For example, when you sign up with Lulu, you establish a password-protected personal account for creating, storing and publishing your Content, as well as for using our other services. In order to establish your Lulu account, we will need your name, email address and password. (The password will allow you access to your account; as such, it needs to be as secure as possible. A good password includes seemingly random letters and numbers, and isn't obvious (as an example, we do not suggest using names of a spouse, child, or pet)). Additionally, when you order Content or other paid products or services, we will need the shipping address, billing name and address, as well as the credit card number and expiration date.
5 Non-Personal Information. When you visit and interact with the Site, we and our service providers and business partners may collect Non-Personal Information from sources such as server log files, environmental variables (such as your MAC address, computer type (Windows or Macintosh), screen resolution, OS version, Internet browser, and Internet browser version) and from scanning navigational data to collect Non-Personal Information about our users in order to help us deliver better service and user experience. Such Non-Personal Information could include the web site you were on before coming to Lulu, IP addresses, or areas of site being clicked on most frequently. We and our service providers (including ad servers, outbound email vendors, affiliate vendors and search engine advertising agencies, and providers of web analytics tools) and business partners may also use "cookies" as well as so-called "pixel tags," "web beacons," "clear GIFs" and other similar technologies to help us deliver better service and user experience and to facilitate your ongoing access to and use of our Site. Cookies are small data files stored by your web browser on your computer's hard drive. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular website, to your computer. If you choose to reject all cookies, you may not be able to access the Site.
6 2. How We Use the Information We Collect
7 Personal Information. We may use Personal Information in the following ways:
8 Fulfillment of Requests. We may use Personal Information to fulfill the purpose for which such Personal Information was provided (e.g., to fulfill your purchase or other transaction).
9 Administrative Communications. From time to time we may send you service announcement updates with important information about Lulu. Service announcements may contain information vital to your account, therefore members may not unsubscribe from service announcements.
10 Other Communications. We may notify you via email or through the mail about new features, products and promotions. We may also send you information on carefully screened third parties whose products or services may be of interest to you. If you wish to unsubscribe from these mailings, please review the instructions in Section 6 ("Opt-Out") below.
11 Contests and Surveys. We may occasionally request Personal Information through surveys or contests. Participation in these surveys or contests is completely voluntary. The Personal Information collected is only used for purposes of improving user satisfaction with Lulu products and services, or in some cases, to notify winners and to deliver prizes. No Personal Information collected through these means is shared with or available to other third parties for such third parties' direct marketing purposes.
12 Testimonials. Testimonials are used to show benefits to certain programs Lulu offers. Lulu always seeks consent prior to posting any testimonial in which Personal Information is included.
13 Customer Service. Any Personal Information obtained through your contact with our Customer Service team or communications with us, such as chat or emails, may be recorded to help us provide better service.
14 Internal Business Purposes. We may also use Personal Information about you for our internal business purposes, such as data analysis, audits and so forth.
15 Combining Information. At times, we may combine Personal Information collected from our Site and other information you shared with us to customize our service to you and improve your experience. For example, we may recommend products or offers you may be interested in based on what you have liked in the past, or remind you that you have an "active" shopping cart waiting for you. Additionally, in order to provide certain services to you, we may on occasion supplement the Personal Information you submitted to us with information from third party sources. For example, we use the US Postal Service's national change of address database in order to verify customer mailing addresses.
16 Non-Personal Information. Because Non-Personal Information does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to share Non-Personal Information, which does not personally identify you, with third parties, for any purpose. For example, we might tell our business partners that a certain percentage of our customers live in California, while a different percentage live in New Jersey. In some instances, we may combine Non-Personal Information with Personal Information (such as combining your name with your geographic location). If we do combine any Non-Personal Information with Personal Information, the combined information will be treated by us as Personal Information hereunder as long as it is so combined.
17 3. Disclosures of Personal Information
18 Third Party Service Providers. Lulu shares Personal Information with carefully screened third-party service providers to provide you with the products, services and information you have requested. Examples of such third-party service providers include credit card authorization companies, merchandise distributors, and shippers. Lulu has instructed these service providers not to store, retain or access your Personal Information except to provide our services to you.
19 Third Party Products and Sites. Lulu also may share Personal Information with third parties to allow such third parties to provide you with the products, services and information that you have requested. This could include, but is not limited to packages of discounts, rebates, and promotional offers, that are not Lulu products, services or information. Such third parties from whom you have requested products, services and information will handle, store, retain, use, share and access Personal Information in accordance with the terms and conditions of their agreement(s) with you, as well as their own privacy policies, and may use your Personal Information for direct marketing purposes. It is your responsibility to carefully review such terms and conditions and privacy policies, and Lulu disclaims any and all liability relating thereto.
20 Third Party Communications. Lulu also may share Personal Information with third parties for such third parties' direct marketing purposes. Such third parties to whom we transfer Personal Information for direct marketing purposes will handle, store, retain, use, share and access Personal Information in accordance with their own privacy policies. It is your responsibility to carefully review such terms and conditions and privacy policies, and Lulu disclaims any and all liability relating thereto. If you would prefer that we do not share your Personal Information with such third parties for their direct marketing purposes, you may submit an opt-out request as described in Section 6 ("Opt-Out") below.
21 Forums. Through the Site, Lulu may make available forums to which you can post information and materials. These forums may include, for example, user forums and blogs. Please note that any information you disclose through such services becomes public information, and may be available to users of the Site and to the general public. In addition, when you choose to make a posting on such services, certain Personal Information (for example, a user's name will appear next to a blog post or a user comment) will be available for other users to view. We urge you to exercise discretion and caution when deciding to disclose Personal Information, or any other information, through the Site. WE ARE NOT RESPONSIBLE FOR THE USE OF ANY PERSONAL INFORMATION YOU VOLUNTARILY DISCLOSE THROUGH THESE SERVICES.
22 Law Enforcement; Emergencies; Compliance. Lulu may disclose Personal Information in the following situations as we believe to be appropriate, even though you might have requested that we don't share your information: (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests, including requests from law enforcement and regulatory authorities; (d) to enforce our terms and conditions; (e) to protect our operations; (f) to protect the rights, privacy, safety or property of Lulu, you or others; and (g) to permit us to pursue available remedies or limit the damages that we may sustain. For example, we may, to the fullest extent the law allows, disclose Personal Information to law enforcement agencies and regulatory authorities to assist them in identifying individuals who have been or may be engaged in unlawful activities.
23 Assignment. We reserve the right to transfer Personal Information to a new entity or third party as part of a merger, acquisition, reorganization, sale of some or all of our assets, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). We will notify you via email and/or prominent notice on our Web site if the third party's or new entity's treatment of Personal Information will materially differ from the treatment described in this Privacy Policy; this notice will be provided at least 30 days before such material changes take effect.
24 4. Protecting Your Content
25 Lulu is designed to give you the ability to control who may access the Content and any associated information stored in your Lulu account. We seek not to make your Content publicly accessible, except by your explicit action, or as otherwise noted in this Privacy Policy (including in Section 3 of this Privacy Policy).
26 In order to provide quality products, the Lulu employees and third-party service providers fulfilling your order or providing Customer Support to you may see your Content.
27 5. Updating Your Personal Information
28 Lulu will make an effort to keep all your Personal Information up to date when you provide it to us. You can update your account information and change your password at any time. On Lulu.com, you will find this at My Projects > My Account & Orders > About Me. If you have forgotten your password, you can set a new one by clicking the “Forgot My Password” link on the login page or by contacting our Customer Service team. If any of your Personal Information changes, or you identify a mistake in our records, please contact us and we will update your data.
29 As a Lulu API customer, you can update your account information from the Developer Portal in your User Account.
30 6. Opt-Out
31 You may unsubscribe to our notification services through your account profile on the Lulu.com Site. Simply go to the My Projects > My Account & Orders > Preferences page or contact our Customer Service team. From time to time Lulu may share Personal Information with affiliates or third parties to allow them to contact you regarding products, programs, services and promotions that we believe may be of interest to you. If you would prefer that we do not share your Personal Information with affiliates and/or third parties for such affiliates' and/or third parties' direct marketing purposes, you may submit an opt-out request by going to the My Projects > My Account & Orders > Preferences page. We will comply with your request as soon as reasonably practicable. Please note that we will not be able to remove your Personal Information from the databases of affiliates or third parties with which we have already shared your Personal Information as of the date that we implement your opt-out request. If you wish to cease receiving marketing-related e-mails from any such affiliates or third parties, please contact the affiliate or third party directly or use any opt-out mechanisms provided in its marketing-related e-mails or privacy policy.
32 As a Lulu API customer, you may unsubscribe from notification services through your account profile. Simply log in and go to User Account, and select which notifications you would like to receive. Once completed, click Update.
33 7. Security
34 Lulu seeks to have reasonable security measures in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. As a result, although we strive to protect Personal Information about you, we cannot ensure or warrant the security of any information you transmit to us through or in connection with the Site or that is stored by us. You acknowledge and agree that any information you transmit through the Site or upload for storage in connection with the Site is so transmitted or stored at your own risk. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with Section 11 ("Contact Us") below (note that if you choose to notify us via physical mail, this will delay the time it takes for us to respond to the problem).
35 8. Protecting the Privacy of Children
36 The Lulu.com, Picture.com and Replayphotos.com Sites are not intended for use by children under the age of 13 and is not directed at such children. We do not knowingly collect Personal Information from children under the age of 13. Please do not register at those Sites if you are under the age of 13.
37 9. Third Party Sites
38 The Site may contain links to third party websites. These linked sites are not under our control and we are not responsible for the privacy practices or the contents of any such linked site, or any link contained in any linked site. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by us. If you provide any Personal Information through any such third party website, your transaction will occur on such third party's website (not the Site) and the Personal Information you provide will be collected by, and controlled by the privacy policy of that third party. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties. PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.
39 10. Changes and Notification
40 We reserve the right to modify our Privacy Policy at any time. If our Privacy Policy changes, the revised policy will be posted on the Site and we will change the 'Last Updated' date at the top of this page to reflect the date of the modification. Please check back periodically. Any changes to our Privacy Policy will become effective upon our posting of the revised Privacy Policy on the Site. Use of the Site following such changes constitutes your acceptance of the revised Privacy Policy then in effect.

43 12. Jurisdictional Issues Welcome to Lulu Press, Inc. (“Lulu”, “we”, “us”, and its derivatives). Lulu makes available a multi-component SaaS platform and provides related services (the platform, software tools and resources, professional services and Site, collectively, the “Services”) that facilitate on-demand production and fulfillment of products such as books, calendars, and other branded and/or personalized merchandise that incorporate user-provided content. We are committed to protecting your privacy when you use the Services, and this Privacy Policy (the “Policy”) describes how we collect and use information about individuals related to the Services. As used herein, “you” and “user” are used interchangeably and refer to anyone who visits our Site or uses the Services. By visiting the Site and or using the Services, you consent to the practices described in this Policy.

46 1. Data Types and Overview
47 Personal Data means data that allows someone to identify or contact you, (for example, your name, address, telephone number, and e-mail address) as well as any other non-public information about you that can be associated with or linked to any data that allows the identification of individuals.
48 Anonymous Data means data that is not associated with or linked to your Personal Data. Anonymous Data does not, by itself, permit the identification of individual people. We collect Personal Data and Anonymous Data, as described below.
49 We collect and use both Personal Data and Anonymous Data about users to (i) provide, measure, and improve the Services, (ii) communicate with you about your Account (as defined below) or transactions, (iii) send you information about changes to the Services or our policies, (iv) send you offers and promotions, (v) personalize content for you on the Services, (vi) detect, investigate and prevent activities that may violate our policies or applicable law, and (vii) as otherwise described in this Policy.

52 You do not have to provide Personal Data to use the Site. However, you may need to provide certain Personal Information use select Services, such as when you create a user account (an “Account”). When you create or update an Account, you must provide Personal Data that lets us contact you and deliver items purchased through the paid professional services, and when you place an order we collect financial details such as your bank account number and/or credit card number that allow us or our third party service providers to process payments (“Financial Information”) all of which we may store and use as set forth in this Policy. In addition, we may collect the following information in connection with the Services and Site:
53 If you tell us where you are (e.g., by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based information. This feature may be deactivated in the location settings of your device.
54 After you establish an account, our Site lets you store preferences like how your content is displayed, your location, and safe search settings. As more fully described in our Terms of Use , we may associate these choices with your ID, browser or mobile device.
55 We retain information on your behalf, such as content submitted via the Services in connection with an order, the creation of content, or the distribution of content.
56 If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to reply.

63 Information Collected by Our Servers. To make our Site and Services more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.
64 Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Services, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Services to our users’ needs. For example, some of the information may be collected so that when you visit the Site or the Services again, it will recognize you and the information could then be used to serve information more appropriate to your interests. Except as noted in this Policy, we do not link this automatically-collected data to Personal Data.
65 Cookies. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience of the Services.
66 Pixel Tags. In addition, we use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, that track online movements of web users. In contrast to Cookies, Pixel Tags are embedded invisibly in Web pages and not stored on a user’s computer. Pixel Tags also let us to send e-mail messages in a format users can read, and tell us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our users. We do not tie the information gathered by Pixel Tags to our users’ Personal Data.
67 Flash LSOs. When we post videos, third parties may use local shared objects, known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features. Flash Cookies are different from browser Cookies because of the amount and type of data and how the data is stored. Cookie management tools provided by your browser will not remove Flash Cookies.
68 How We Respond to Do Not Track Signals. Users may use the Lulu Privacy Setting tool to customize the amount of data that they will allow Lulu to collect when the User is accessing Lulu’s Site(s) or Services.
69 Analytics Services. Other companies may set their own cookies or similar tools when you visit our Site or use the Services. This includes third party analytics services that we engage to help analyze how users use the Services. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information we get from Analytics Services only to improve our Site and Services. The information generated by the Cookies or other technologies about your use of our Site and Services (the “Analytics Information”) is transmitted to the Analytics Services, which use Analytics Information to compile reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and Privacy Policy. By using our Site and Services, you consent to the processing of data about you by Analytics Services in the manner and for the purposes set out above. 70 Information Collected from Third Parties
71 We may receive Personal and/or Anonymous Data about you from companies that provide our Services by way of a co-branded or private-labeled Site or companies that offer their products and/or services on our Site. We may add this information to the information we have already collected from you as described in this Policy in order to improve the Services

74 Personal Data you submit to us is typically used either to provide the Services, respond to requests that you or your customers make, or help us better serve you and your customers. We use your Personal Data in the following ways:

83 User Testimonials and Feedback; Forums
84 We often receive testimonials and comments from users who have had positive experiences with our Services. We occasionally publish such content. When we do so, we may identify our users by their first and last name and indicate their home city, but will obtain the user’s consent prior to posting this information with the testimonial. We may post user feedback with a first name and last initial, or an Account handle that does not allow identification of the user, without obtaining advance consent. When you provide Feedback with respect to the Services, you consent to our using such Feedback, and identifying it, as described in this section.
85 If you make any comments on a blog or forum associated with your Site, you should be aware that any Personal Data you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. Even if you later delete the information, it may have been saved by other users on their computers and deleting the post will not affect any such other copies of the information. We are not responsible for the Personal Data you choose to submit in these blogs and forums.
86 Disclosure of Personal Data.
87 Third Party Service Providers. We may share your Personal Data with third party service providers to: provide you with the Services that we offer you through our Site; to conduct quality assurance testing; to facilitate creation of Accounts; to provide technical support; and/or to provide other services to Lulu. These third-party service providers are required not to use your Personal Data other than to provide the services requested by Lulu.
88 Affiliates. We may share some or all of your Personal Data with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Policy. Corporate Restructuring. We may share some or all of your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Policy.

Regardless of any choices you make regarding your Personal Data (as described below), we may disclose Personal Data if we believe in good faith that such disclosure is necessary (i) in connection with any legal investigation; (ii) to comply with relevant laws or to respond to subpoenas or warrants served on Company; (iii) to protect or defend the rights or property of Company or users of the Site or Services; and/or (iv) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use .

91 Lulu is designed to give you the ability to control who may access the Content and any associated information stored in your Lulu account. 96 Our Site and Services may contain links to third party websites. The links to third party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content or websites. When you click on a link to any other website, you will leave our Site or Services and go to another Site, and another entity may collect Personal Data from or about you. We have no control over, do not review, and cannot be responsible for, these outside websites, their content, or their practices. This Policy does not apply to these outside websites. We encourage you to read the privacy policies of every website you visit.
97 7. Your Choices Regarding Information.
98 You have several choices regarding the use of information with our Services:
99 Email Communications. We may periodically send you newsletters and e-mails that promote our Site or Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or updating your preferences in your Account Profile pages of the Site(s). Despite your indicated e-mail preferences, we may send you service related communications, including notices of any updates to our Terms of Use or this Policy, via the email address associated with your Account.
100 Cookies. If you decide at any time that you no longer wish to accept Cookies from our Service, you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. If you do not accept Cookies, however, you may not be able to use all portions of the Services or all functionality of the Services. 101 Changing or Deleting Your Personal Data. All users may review, update, correct or delete the Personal Data in their Account via the “My Account” page within the Services. If you completely delete all of your Personal Data, then your Account may be deactivated. We will use commercially reasonable efforts to honor your request.
