This data is collected in order to identify suitable members and put them in touch with you as well as to improve our Site and Service. For this purpose, data is made anonymous, i.e. it is only sent to potentially interested members using your pseudonym. You yourself decide what information appears in your profile. Personal information that may identify you is not permitted on your Ad Profile. Please note that you may upload photos to your Ad Profile. The type of photos you upload may clearly identify you. The data is also collected for commercial, promotional, advertising and business purposes;
7 (ii) When you order credits we and/or our third party affiliates and payment processors, process financial information required for the payment transaction, such as name, address and your credit card data (such as number, issuing institution and expiry date) or account details (account holder, account number, sort code, institution), and

9 2. What information do you gather automatically from visitors?
10 We use your IP address (the series of numbers associated with your individual computer) to help us maintain our site, identify problems with our server and to provide you with an enhanced experience. We do use cookies to identify traffic that comes through advertising and to facilitate a more user friendly experience. Accessing and updating your email notification preferences, personal information and public information You have the opportunity to opt-out of certain communications and modify personal information or demographic information you have provided to us, and to hide information visible to the public users of the Website at any time by going to the 'Manage Profile' or 'Message Center' sections on your Ad Profile.
30 Please be aware that it may take several hours for any custom changes you make to take effect on the public areas of the system. Please also note that changing or deleting your information through the 'Manage Profile' or 'Message Center' section of the system, or opting-out of email notifications from us, will only change or delete the data in our database for the purpose of future activities and communications. These changes and deletions will not change or delete information or emails that are queued to be sent or have already been sent.
31 5. Unsolicited Contact (SPAM)
32 Ashley Madison, our affiliates and our channel partners do not send unsolicited email at any time. However you hereby consent to receive email messages to the email address you register on your Ad Profile e.g. for marketing purposes and from members. 33 6. Do you monitor online behavior?
34 Our users communicate with each other through on-site Mail Messaging and Instant Messaging. While we do not, as a rule, moderate or monitor members' private exchanges, we reserve the right to do so if we suspect users of being under the age of 18 or of using our service for the purpose of solicitation or any other violation of our Terms & Conditions or Privacy Statement. Submissions that appear on the public area of the site are moderated and, if necessary, we reserve the right to edit, delete, remove or not use any communication on a public area of the site.

To the extent permitted by applicable law, we may supplement this with information about your IP address, or your location, when you use the Services.
69 While creating your profile, you may choose how much Personal Data you share with us. You will be asked to create a username and offered the chance to upload a photograph and provide a personal description. You are encouraged to create a pseudonymous profile and are not required to include information in your profile that would allow you to be directly identified. If you want to remain anonymous, please be careful about what you choose to share, especially if you upload photographs or choose a username which could allow you to be easily identified.
70 When you make a purchase off our Platform you will be asked for certain Personal Data for billing purposes including your name, address and details of your chosen payment method in order for us to be able to process your transaction.
71 With your permission, we will also collect your location information from your mobile device to help you identify other Platform members in your area. You may turn off this feature through the location settings on your mobile device. We also collect your general geographic location from your browser access to help you identify members in your area and to help us quickly and efficiently respond to inquiries and requests.
72 If you choose to activate 2-factor authentication for your account, we will ask for your phone number. This phone number will be shared with a third party service provider Nexmo. Nexmo service is not part of the Service, and is subject to separate terms and conditions, including different policies with respect to the collection, use and disclosure of your personal information. We do not have control over Nexmo. You will need to make your own independent judgment regarding your interaction with them. Please note that if you decide to delete your Ashley Madison account, we will delete your phone number from our records but Nexmo will not.
73 If you contact our customer support team we may ask you to provide your user name and email address for the purposes of resolving any queries or issues which you may have with the services.
74 We do not actively collect the information which you include in messages sent between users on the site but this information is available to us and may be monitored for fraud. You should only include personal information about yourself in these messages unless you have the consent of any other individual to include their information. We will presume that where you include the personal information of any other individual in such messages that you have their consent to do so.
75 Some of the information described above and required to be able to provide the Service to you may be considered “sensitive information” under the applicable laws of your jurisdiction of residence. We will only process this information where we have obtained your explicit consent to do so. 82 Google Analytics. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. This website uses Google Analytics with the expansion '_anonymizeIp()'; therefore, only abbreviated IP addresses will be further processed, so that a direct connection to the individual user is eliminated. Your IP address will be shortened beforehand by Google (i.e. the last octet of the IP address will be anonymized) within member states of the European Union or in other signatory states of the Treaty on the European Economic Area. 125 Promotion of your Profile – We may share your nickname or username (not your actual name) and your photo to promote your profile to other users of the Services, who may be located in any country in the world where our Services are offered.
